Nothing in biology makes sense except in the light of evolution,” goes the saying. Similarly, nothing in society makes sense except in the light of power. And that goes for speech, too. Speech, just like other freedoms, is an assertion of a right that naturally bumps up against rights of others—most commonly right to dignity, right to privacy, right to be free of violence and sometimes right to private property. Decisions and proclamations about which right (“naturally”) trumps when the right to speech bumps against other rights reveals something about the workings of power, privilege and status in a society.
